TERMS OF SERVICE
Last updated: October 2, 2026Please read these Terms of Service carefully before using steventhesier.com (the "Website").
These Terms govern your use of the Website and, where applicable, the process of requesting or scheduling services through the Website. By accessing or using the Website, you agree to these Terms.
1. About the Website
The Website is operated by Steven F. Thesier ("I," "me," "my," or "we").
The Website provides information about my creative work, portfolio projects, media projects, and professional services, including web design, podcast and video production, editing, and project management.
Content on the Website is provided primarily for informational and portfolio purposes and may change, be updated, or become unavailable over time.
2. Use of the Website
You may use the Website for lawful purposes and in accordance with these Terms.
You agree not to:
Use the Website in a way that violates applicable law or regulation.
Attempt to gain unauthorized access to the Website or its systems.
Interfere with the operation or security of the Website.
Copy, reproduce, distribute, or exploit Website content except as permitted by law or with permission.
Use the Website or its content to misrepresent your affiliation with me or my work.
3. Services
Information about my services on the Website is provided for general informational purposes.
Services may include:
Web design and Squarespace development
Podcast and video production
Video and audio editing
Project coordination and management
Related creative or digital support
The exact scope, deliverables, schedule, fees, payment terms, and other project requirements may vary by engagement.
When a service engagement is accepted, the project may be governed by a separate Statement of Work, proposal, contract, or other written agreement between me and the client.
Where a project-specific agreement exists, that agreement controls the specific terms of that engagement. If there is a conflict between these Website Terms and a project-specific agreement, the project-specific agreement will control for that project.
4. Consultations and Scheduling
Paid consultations may be booked through Acuity Scheduling.
Consultation fees are non-refundable, unless I expressly agree otherwise in writing.
If you experience a scheduling issue, you should contact me as soon as possible. Rescheduling may be considered on a case-by-case basis, but a scheduling issue does not automatically create a right to a refund.
Booking a consultation does not create an obligation for either party to enter into a separate service engagement.
5. Project Deposits and Payments
For service projects, I may require a 50% deposit before work begins unless otherwise stated in a project-specific agreement.
Project payments, milestones, and remaining balances may vary depending on the scope and requirements of the project.
A deposit is generally non-refundable once work has begun, except where otherwise agreed in writing or required by applicable law.
If a project is terminated before completion, the client remains responsible for amounts due for work completed, approved milestones, and any non-cancelable expenses incurred on the client's behalf.
Where a project is terminated close to completion, the remaining balance may become due based on the amount of work completed and the terms of the applicable SOW or agreement.
Payment may be made through third-party payment providers, including PayPal.
6. Project Changes and Client Responsibilities
Clients are responsible for providing information, content, approvals, access, feedback, and other materials reasonably necessary to complete a project.
Delays in providing required materials, approvals, or feedback may affect project schedules and delivery dates.
Changes to project scope may require adjustments to fees, milestones, or deadlines. Significant changes may be documented through an updated SOW, written approval, or other written agreement.
7. Intellectual Property
Unless otherwise stated in a project-specific agreement, the following applies.
Upon full payment for a project, the client receives ownership of the final deliverables specifically created for that client as part of the agreed scope.
I retain ownership of:
Pre-existing materials
Reusable templates
Processes, methods, systems, and know-how
General creative techniques
Tools or materials not created specifically for the client
Any third-party materials subject to separate licenses or ownership rights
Third-party fonts, stock media, plugins, music, software, trademarks, or other licensed materials remain subject to their respective license terms.
8. Portfolio and Promotional Use
Unless otherwise agreed in writing, I reserve the right to display completed work created for a client in my portfolio, on steventhesier.com, on social media, in presentations, and in other promotional materials.
This may include the final deliverables and related materials such as:
Website designs and screenshots
Logos and brand assets
Video and audio work
Sonics and other audio elements
Graphics and creative assets
Project descriptions and excerpts
I may identify the client or project where reasonably appropriate.
If a project contains confidential or sensitive information, the parties may agree in writing to restrictions on portfolio or promotional use.
9. Website Content and Availability
The Website and its content are provided for general informational and portfolio purposes.
Projects, external links, embedded media, and third-party websites may change or become unavailable without notice.
I do not guarantee that every portfolio project shown on the Website remains publicly accessible, active, or representative of the current status of the associated organization or service.

Unless otherwise noted, the content of the Website—including text, original graphics, branding, design elements, photographs, videos, audio, and other original materials—is owned by or licensed to me.

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules.
17. Dispute Resolution
If a dispute arises concerning use of the Website, I encourage you to contact me first so that we can attempt to resolve the matter informally.
Nothing in this section prevents either party from pursuing rights or remedies that cannot lawfully be waived.
18. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
19. Changes to These Terms
I may update these Terms from time to time.
